Perselisihan terkait Potongan Iuran Serikat Pekerja PT. Central Mega Kencana

Jakarta, Buruh Online - "Mengabulkan gugatan Penggugat untuk sebagian," ujar Hakim Duta Baskara membacakan amar Putusan dalam Perkara Nomor 99/Pdt.Sus-PHI/2019/PN.Jkt.Pst, antara Pengurus Unit Kerja (PUK) Serikat Pekerja (SP) Kimia Energi Pertambangan (KEP) melawan PT. Central Mega Kencana (PT. CMK), senin (15/7/2019) di Ruang Sidang Oemar Seno 2.

"Menyatakan pemotongan iuran Serikat Pekerja melalui Perusahaan beralasan hukum dan dapat dilaksanakan," tegas Duta. Ia juga memerintahkan Perusahaan untuk menambahkan syarat kerja baru dalam Peraturan Perusahaan, terkait pelaksanaan pemotongan iuran serikat pekerja atas upah Pekerja yang menjadi anggota SPKEP di PT. Central Mega Kencana.

"Syukur, Alhamdulillah pada hari ini, Majelis Hakim sangat mementingkan kepentingan teman-teman buruh," ujar Tohenda dan Solihin. Dirinya juga menambahkan, karena perkara tersebut merupakan perselisihan kepentingan, maka menurutnya, tidak ada lagi upaya hukum yang dapat dilakukan, selain melaksanakannya.

Tohenda pada kesempatan persidangan sebelumnya, mengatakan, bahwa pihaknya menganggap segala syarat administrasi agar Perusahaan membantu pemotongan upah untuk iuran serikat pekerja yang diatur dalam ketentuan perundang-undangan, telah pihaknya penuhi. Lagipula menurutnya sudah ada kesepakatan antara Serikat Pekerja bersama Pengusaha PT. Central Mega Kencana, yang menyepakati pelaksanaan bantuan pemotongan iuran apabila telah mempunyai rekening bank dan surat kuasa dari anggota.

"Kami berharap Perusahaan tidak ego dan tidak melihatnya sebagai pasal kewajiban. karena jika hal-hal yang kecil seperti ini hendak diuji kebenaran materilnya melalui undang-undang, justru akan menciptakan hubungan industrial yang tidak baik dan akan menghambat produktifitas Perusahaan," ujarnya kala itu.

Tohenda on the occasion of the previous trial, said that his party considered all administrative requirements for the Company to help withholding wages for union contributions stipulated in the legislation, it had fulfilled. Moreover, according to him, there was already an agreement between the Trade Unions and the Employers of PT. Central Mega Kencana, which agreed to the implementation of assistance withholding contributions if it already has a bank account and power of attorney from members.


"We hope that the company does not act as an ego and does not see it as a liability article, because if small matters like this are to be tested for material truth through the law, it will create bad industrial relations and will hamper the Company's productivity," he said at the time.
